Photo sharing site Instagram found itself in hot water when it released updated terms of service on 18 December.  Users and commentators alike speculated that the shifts in the terms of service meant that Instagram intended to employ user content on the site for commercial purposes.  Essentially, the new terms give Instagram the right to use and the ability transfer its right to use, user content without compensation of any kind to users.  The new terms also simultaneously limited the rights of users to engage in class action lawsuits against Instagram, limited damages to $100, waived users’ ability to obtain injunctive relief, limited the statute of limitations to one year, and required agreement to arbitration.  The announcement caused an outcry on the internet, and Instagram released a public statement on the site’s blog attempting to clarify the terms and quell the fear and fury surrounding the changes.  The terms have again been modified from the previous proposed version, however much of the terms users find most egregious remain present.  Although there is conflicting information, some reports state that as much as 25% of Instagram’s users deleted their accounts over the new terms, which are to come into force 19 January, 2013.
However, a loss of users is not the only problem looming for the site—on 21 December, 2012, a class action lawsuit was filed against Instagram in U.S. District Court for the Northern District of California related to the new terms, Funes v. Instagram Inc., 12- CV-6482 (N.D. Cal.).  Essentially, the complaint theorizes that with its new terms Instagram is appropriating users’ property and then shielding itself from liability for doing so.  The plaintiff brings claims for breach of contract for violation of the implied covenant of good faith and fair dealing, for violation of California Civil Code §3344 (the statute protects the individual’s ability control the commercial use of his or her name, image, likeness, or other aspects of one’s identity), breach of bailment, and for violation of California business law.  The case also seeks declaratory relief regarding the lawfulness of Instagram’s conduct as well as injunctive relief and attorney’s fees.  The lawsuit appears to be the first of its kind.
Even though Instagram amended its proposed terms of service, attempting to provide some clarification on 20 December, the new terms still grant Instagram “a non-exclusive, fully paid and royalty-free, transferable, sub-licensable, worldwide license to use the Content that you post on or through the Service.”  It seems that many photo sharing, blogging, and cloud file storage websites have terms granting some sort of limited license related to user content to the hosting site.  However, the license Instagram proposes has much greater breadth than those included in most standard terms.
Although it is unclear whether users will have any success in a lawsuit against Instagram, these events have important implications.  This case may signal a shift in the way user content is utilized by host sites, as well as in users’ ability to contest terms they find egregious through legal process.  As more photographers and artists rely on the internet for marketing and the ability to store images via cloud computing, the terms of service employed by hosting sites will be of critical importance to those who are concerned about how and where their images may be used in the future.

According to many customers, sites hosted by major web host and domain registrar GoDaddy are down. According to the official GoDaddy Twitter account the company is aware of the issue and is working to resolve it. Update: customers are complaining that GoDaddy hosted e-mail accounts are down as well.

Update 2: Anonymous is claiming responsibility. A member of Anonymous known as is claiming responsibility, and makes it clear this is not an Anonymous collective action.

A custom AOKP Jellybean 4.1 ROM is not available for Samsung Galaxy Note i717 users.
Below are a list of features, courtesy of Pradeep Neela of www.adroiddevices.com, included in the firmware and installation instructions.

Features of AOKP Jellybean 4.1.1 Firmware:

Instructions:
All the data in your Galaxy Note should be backed up with the help of below mentioned steps manually. Alternatively, you can also make use of KIES to back up all the data, but it’s highly recommended that you backup the data with the help of below steps so that it will be useful for future as well.

1. SMS – Use “SMS Backup & Restore app”,
2. Contacts – Sync with the Gmail application,
3. Call Log - Call Log and Restore
4. Images, Songs, Videos, Files – Copy to internal / External SD Card,
5. APN and MMS Settings – Note down from the path “Applications > Settings > Wireless and Network > Mobile Networks > Access Point Names”

• From the path “Settings > Applications > Development > USB debugging”, enable USB Debugging Mode in your Galaxy Note i717. Also, you need to ensure that the minimum battery charge left in your phone is not less than 40% or else the phone may get turned Off in the middle of firmware update.

So assuming that you have followed all the above mentioned instructions, you can now proceed to the next page where we have summed up detailed tutorial on how to apply this update in your Galaxy Note i717.

Procedure to Update Galaxy Note i717 with AOKP Jellybean 4.1.1 firmware:

• Download the AOKP Firmware Package and Google Apps Package from here to your computer. Once downloaded connect your device to the computer with the help of USB cable and then place these two zip files in your computer.

• Once you have placed the files in your phone, disconnect the device and turn off the same so that it can be entered in the recovery mode.

• Galaxy Note i717 can be entered in the recovery mode by pressing Volume Down Key + OK button, and holding both simultaneously press the Power Button. Now, a Warning message will be shown when you need to press the Volume Down key to continue entering the Recovery Mode. If the device boots in the normal mode, you will have to reboot the device again in the recovery mode by following the above procedure.

• Select “install zip from sd card” > “choose zip from sd card” and select the Rocket ROM Firmware Package. It will take around 6 – 8 minutes for applying this update. After this, you need to select “++++ Go Back ++++” and then select “reboot system now” to reboot the phone in the ICS Android 4.0.4 firmware.

Note: Just in a rare case if your Samsung device refuses to turn ON or say if it gets stuck on the Samsung Logo then you need to long press the power button to turn off the same or re insert the battery to start the process from beginning.

After the second quarter this year, iPhone sales were up only 3%, a huge drop for one of the best selling smartphones on the market. According to sources, AT&T store managers have instructed employees to steer customers away from Apple iPhones and push Android or Microsoft phones.  Employees, in some stores, are not permitted to choose an iPhone as a company owned device.

Randi Zuckerberg, sister of Facebook CEO Mark Zuckerberg, recently Tweeted “..There are officially more Zuckerberg family members working for Google than Facebook”.  This came after Google’s acquisition of Wildfire, a social media marketing firm.  Her sister, Arielle Zuckerberg, is employed as a Junior Product Manager with Wildfire.  Does Randi’s tweet suggest she may be teaming with Google in the near future?  Randi left Facebook last year to start her own business and is currently working with Bravo on its Silicon Valley entrepreneur reality show.

What does this say about the health of Facebook?   Did Randi leave the company due to insight of a failing social media giant that’s sinking faster than the byproduct from the dicey breakfast burrito consumed only hours ago?  Remember, according to the American Customer Satisfaction Index (ACSI), Facebook’s customer satisfaction rating has plummeted each of the last two years.  Only time will tell, but the two sentence Tweet is indicative of possible things to come. Google Fiber-Break neck internet speeds!

Last week, Google announced that they will be launching their brand of high speed internet and digital television services called Google Fiber.  The United States is well behind average speeds around the world, with a nationwide average of 5mbs.  With Google Fiber, speeds claim to be around 1Gbps, well over 100 times faster than current speeds.  Google has also announced with a subscription to Fiber, there will be no data caps, no throttling, no limitations. Google demonstrated this by downloading a 500mb file in under 10 seconds.  If you current speeds at home are anything like mine, that may have taken 10-20 minutes to complete.

Google also announced Fiber TV, a digital HD alternative to your current provider.  Fiber TV allows users to download up to 500 hours of HD television content and record up to eight channels at once. Google Fiber TV can be controlled by either a bluetooth remote or an app on a tablet or smartphone. The Google Fiber TV app will also stream DVR recordings straight to tablets or smartphones.  Google showed off the Network Box that will connect to a Fiber jack in the wall. Features Wi-Fi and easy to understand settings management. With two terabytes of storage, it can store up to 500 hours of HD content. The TV box has a built in Wi-Fi access point to stream content to all the other TVs in the house.

Also, everybody who signs up for Fiber will get a free Nexus 7 tablet, which can be used as a remote in addition to all the other snazzy features (Jellybean, people). The direct Fiber connection costs them a lot of money and requires some construction on their part. To offset that cost, Google said that a direct Fiber connection will increase the value of your house by $5,000.  If a two year contract is signed, the $300 is waived.
As for packages, the full Google TV package which includes the Fiber Internet, every channel, the Nexus 7 tablet and more will cost you $120 a month.

Google will be installing Fiber in September after a rally that will gauge interest to see which neighborhoods who want Fiber the most. For those neighborhoods who get Fiber, all public buildings in the vicinity including schools and libraries will get free Fiber Internet.
All in all, this is an amazing value for both the TV and Internet package.

Facebook has been the social media king for the last several years, previously smashing Myspace from existence (or very nearly).  I am personally grateful to Facebook for destroying the glittering, mindless labyrinth that was the personal Myspace page.  My love for Facebook stops there.  Continuous changes to the website have created/exacerbated privacy issues, undesirable layouts, and advertisements that are aesthetically similar to a Jackson Pollack painting.  Now that I think of it, Facebook has become a variation of Myspace. An image of Darth Sidious tapping his fingers together, saying “good, good” just came to mind.

The American Customer Satisfaction Index (ACSI) recently released its latest report detailing how customers feel about search engines, portals, and social media platforms.  In this category, Facebook took the largest hit, dropping from last year’s 66/100 to 61/100.  In comparison, Google+ scored 78/100 in its first year.  Google+, as with most Google applications, has unmatchable privacy, aesthetic, and functionality.  Google+’s Circles feature allows posts only be seen by people in certain circles (i.e. Friends, Co-workers, mental cases, etc.). So if you feel the need to post “I’m going to the Finger Lakes this weekend”, you’re psycho ex-girlfriend (who you have a restraining order against) most likely will not catch wind and follow you up there and kill you.  See, Google+ keeps you alive!

Well that doesn’t mean the world will end, or that facebook will melt because the ice cream sandwich (ICS) apocalypse has arrived. I had the same issue and fixed it. I have included some instructions and links below.

How to manually install I717UCLF6 ICS 4.0.4 Stock ROM Samsung Galaxy Note SGH-I717

- Back-up all important data stored from the device
- Make sure the battery is fully charge
- Use PC runs with Windows OS and good USB serial port
- Grab stock ROM, USB driver and Odin
- Extract the downloaded stock Firmware

1) Run Odin
2) Click on the PDA button, then load the I717UCLF6_I717ATTLF6_I717UCLF6_HOME.tar.md5 (This file is found only after it is unzipped)
3) The “Re-partition” checkbox SHOULD NOT be checked **Important**

4) Reboot the Galaxy Note in Download Mode: Turn it off > (Press Volume Down+Home+Power button) then Press Volume Up when the Warning message appear
5) Connect the phone to PC, using the supplied USB cable
6) Hit “START” button to begin flashing
7) Wait until the flashing finishes (DO NOT ever interrupt the process once already started)
Make factory reset after completely rebooted if ever encountered bootloops

A brief review of Robin: The future of voice recognition or another failed attempt?

Android  has been frantically trying to compete with Apple’s Siri since the release of iPhone 4s.  We now have Robin, advertised by some as a “Siri Killer”.  Shortly after downloading Robin from Google Play, most will spend half an hour asking the program obscure, suggestive, and/or meaningless questions.  This can be a great source of entertainment, being Robin has its own programmed Easter Eggs.  The famed “Where to hide a body” question Siri will assist with, Robin suggests you continue using Siri for this line of work.  So, if you are an apprentice assassin, stick with your iPhone 4s.  Robin’s real claim to fame is as a driver’s new best friend.  Robin can find gas stations nearby and quote the prices.  You can ask Robin to find the nearest Shell station and follow it up with “Lets go there”, prompting an immediate navigation screen with proper directions.

The following examples were my actual test questions  and the responses from Robin.  There are certain areas, as you will see, the program shines and lots left to be desired.

Question 1: Who is Daniel Day-Lewis?
Answer: (In subtitled speech) Daniel Day-Lewis, Born 1957, a British born Irish actor.
Comments: Robin had a basic understanding of what I was asking.  There are no profile cards or Google search results to compliment Robin’s findings.  If you really didn’t know who Daniel Day-Lewis was, you’d still be left in the cold.

Question 2: Where is the nearest PetSmart?
Answer: Looking for PetSmart.  Followed immediately with pin drop locations on the map, highlighting the location nearest me.
Follow-up: Lets go there!  Robin gave exact directions to the PetSmart I asked for.
*Note: I used PetSmart as an example because the wife was nagging me about buying our dog more treats.  Apparently, 6 bags of random goodies aren’t enough.

Being from the Atlanta area, I decided to deviate from the suburbs and began asking questions pertaining to activities/locations I enjoy during the weekend.

Question 3: Give me directions to Turner Field (Home of the Atlanta Braves).
Answer: “Sorry, I couldn’t understand give me directions to Turner Field.
Follow-up: You can’t be serious….
Ok, so Robin is relatively new and is still needing some updates, retooling, etc.  I’ll let that one slide.

Question 4: Give me directions to The Georgia Aquarium.
Answer: Here are aquariums in Georgia.  (Not exactly what I was looking for, but found the pin drop for the Georgia Aquarium.)

In conclusion, Robin can be a nifty resource for certain queries.  This program certainly is not revolutionary and shouldn’t be considered an equal to Siri.  Good news is coming for Android users, though.  With the release of the Jelly Bean firmware, Google Search is primed to destroy anything on the market to date.  I have included a video of Siri vs. Google Search from TechnoBuffalo below.

What you’ll need

How to update Galaxy Note (AT&T SGH-I717) to Android 4.0.3 With UCLD3

• Step 1: Download the drivers for Galaxy Note to your PC (USB_Driver_for_ATT_I717_Galaxy_Note_v1_3_2200_0.exe) 22 MB.

• Step 2: Download firmware UCLD3 to your PC

(SGH-I717UCLD3-1FB30D08F1D2B2AAAECF49D262E8E707.exe) 902 MB.

• Step 3: Run the Galaxy Note drivers file (USB_Driver_for_ATT_I717_Galaxy_Note_v1_3_2200_0.exe) to install it on the PC.

• Step 4: Run the UCLD3 file (SGH-I717UCLD3-1FB30D08F1D2B2AAAECF49D262E8E707.exe) to install Odin. Switch off the device

• Step 5: Simultaneously press and hold the power and volume buttons to boot the device in download mode. Then use a USB cable to connect to device to the computer.

• Step 6: The Odin’s message box will display an “Added” message once the phone has been connected to the computer. Odin’s first box will show something like“0:[COM#]” if the phone has been recognized.
• Step 7: Click the start button in Odin and to install UCLD3 firmware on the Galaxy Note. The phone will reboot itself few times after a few minutes.
